Terms and Conditions of Sale

1.Interpretation
1.1 In these Conditions the following words shall have the following meanings:
“Customer” The Person named on the purchase/order receipt/invoice
“Products” any goods which the Buyer is to purchase from the Seller (including any of them or any part of them)
“Seller” the person, firm or company who accepts the Buyer’s Order
“Contract” the contract between the Company and Seller for the sale and purchase of the Goods
“Order” any purchase order of the Buyer for the goods, incorporating these terms and conditions
“Premises” any building or premise owned or leased by Ever Furniture Ltd
“Company” Ever Furniture Ltd
1.2 The headings in these terms and conditions are for convenience only and shall not affect their interpretation.
2 .Purchases guarantee
2.1 Any guarantee specified on a product starts from the date of purchase shown on the customer receipt and terminates at the end of the specified period.
2.2 All standard production products are guaranteed against manufacturing defects for no less than a 365 day period unless otherwise stated. See the bottom of this page for the guarantee period on your purchases. A period in the range of 0 to 365 days guarantee may be applied to items which are damaged at the point of sale, fragile in design or made bespoke to the customers’ requirements and considered by the manufacturer or sales team to be less durable. There is no guarantee applied to end of line, clearance or other manufacturers’ products.
2.3 Our guarantee does not cover amongst other things:
Excessive overloading of furniture
Acts of God (Fire, Wind, Flood, lightning etc)
Use of our products in a commercial environment (unless specified otherwise)
Purposeful destruction/damage
Improper or excessive use

2.4 In the event of a claim, the original customer receipt must be shown; a copy or company record will not be accepted.
3. Orders and deposits
3.1 An order placed by the customer for a standard or bespoke production product shall require a deposit, usually of no less than 30% of the products total value.
3.2 The deposit is non-refundable upon cancellation and shall be used as payment to the manufacturer to commence production of that order.
3.3 Customers must ensure that the description on the receipt matches their order.
3.4 We will not hold or store any product or order which has a deposit against it or is fully paid for, unless agreed separately in writing. We reserve the right to sell on any item without warning and re-produce a similar product at a later date subject to a price increase or decrease at the date of re-manufacture.
3.5 All products remain the property of Ever Furniture Ltd until full cleared payment is received and a receipt signed by a Director or appointed authorised person is issued.
3.6 Ever Furniture Ltd reserves the right to enter premises and remove items for which full payment has not been received. If an agent is appointed to take this action, further costs may be incurred. Ever Furniture Ltd will pursue payment for all costs incurred as a direct result of non or delayed payment for its good and services.
3.7 Ever Furniture does not offer a credit or grace payment period for any of its good or services.
4 Excessive delays
4.1 An estimated arrival time is stated on the customer receipt or issued verbally for the products ordered; this is not a binding date of arrival and should not be interpreted as such. If an excessive delay, on standard production items, of greater than 3 months over the estimated arrival time stated on the invoice is incurred then Ever furniture Ltd may offer a refund at the management’s discretion. Similarly an excessive delay, on bespoke production items, of a period greater than 4 months may be treated in the same way.
5. Deposits
5.1 A customer leaving a deposit on stock items or for a bespoke production is required to continue payment on the ordered items at a rate no less than 20% of the full invoices balance every 30 days. Full payment for a bespoke product is due once production is completed and the item is available for delivery. Failure to do this may result in the items being sold and as a result have to be re-ordered at such a time that the customer is compliant to the conditions which may incur further costs for incidentals such as storage, fluctuations in material and manufacturing costs, logistical cost etc. Excessive delay in payments (a period greater than 65 days) or failure to make alternative arrangements or separate agreement with the company may result in the deposit and payments being void and not refundable.
6. Delivery
6.1 Delivery or installation costs are not included in the purchase price unless stated in writing.
6.2 Customers must ensure that access to the property and rooms that will accommodate the delivery are suitable for delivery.
6.3 The purchased items are not refundable due to access restrictions, a credit note may be issued in certain circumstances at the management’s discretion. If the customer is unsure about access, a visit by a member of staff can be arranged at a cost to assess the property access. Ever Furniture Ltd is not responsible to ensure the products can be delivered inside the property if no assessment is first made by our staff and a written assessment is then signed off.
6.4 If the customer is taking products from in store, no liability can be held by Ever Furniture Ltd for breakage or damage beyond the premises.
7.0 Refunds and returns
7.1 Ever Furniture Ltd does not offer a trial period on its products, in the event a customer requires an alteration or change in their purchases this should be discussed with the management.
7.2 When placing an order for Bespoke Furniture, there is no right of cancellation. Once the order has been placed, full payment for the goods will allow delivery of your furniture. If you place an order, and make a deposit payment and then are unable to complete the payment, your deposit will not be refunded. Any order for bespoke furniture that has been paid in full will incur a 40% fee for cancellation.
7.3 Should any goods be faulty or damaged they will be replaced or refunded in full according to the customer’s requirements. If only part of the item is damaged or faulty then we will send out a replacement for what is required.  In the event that the appropriate part cannot be sent, the whole item will be replaced.  Ever Furniture Ltd will pay the return delivery costs and delivery of replacement parts for any damaged or faulty items.
7.4 Ever Furniture Ltd cannot be held responsible for any related expenses such as loss of earnings, electrician’s fees etc. incurred in the event of faulty or missing items being supplied.
7.5 All electrical products supplied by Ever Furniture Ltd must be installed by a qualified electrician.
7.6 Returned products should be in new condition and will be inspected upon return.

PAYMENT PLAN / LAY-BY SCHEME

A minimum amount equal to or greater than 30% of the total value of the product is required to secure an in stock item for a period no greater than 180 days, or to commence production of a bespoke item.  No time limit is expressed or implied when entering into a payment plan with Ever Furniture Ltd, however the following 2 points will apply:

1) Plans which receive contributions of less than £25 in any 180 day period may be cancelled

2) Plans not completed within a 365 day period may be subject to increased costs due to supply, material, logistic and manufacturing cost increases and Ever Furniture Ltd reserves the right to apply these increases.  Any increases will be added to the plan if necessary and the customer shall become liable for these extra charges prior to completion of the plan or delivery of the goods.

A minimum of £5 cash deposit and £20 card deposit can be accepted for each payment.  Any over payments will be refunded in vouchers/credit notes.  Any amount paid toward a product or service in non-transferable.  Products may become discontinued over time, refunds will be offered in vouchers or credit note in this instance.  Any agreement outlined outside of these terms is also legally binding.
